General Terms and Conditions «folienpreise.de»

By activating the checkbox next to statement "I acknowledge the conditions for use" at the end of the registration page, you as a user agree to the following terms and conditions. If you are not in agreement with the terms and conditions, you cannot login. Private individuals may not use this service.

1. Applicability

(A) The terms and conditions below govern the conditions under which folienpreise.de shall be used. These terms and conditions also apply when the provider is accessed outside of the Federal Republic of Germany.

(B) By registering with the provider, the user acknowledges having read and understanding the terms and conditions and hereby accepts them. Any incompatible conditions of the user are hereby rejected.

2. Scope of Services

(A) The provider operates a database in the Internet and offers users access to this database, by means of which users may obtain prices, data, and other information about the professional installation of automotive glass films. Depending on their access level, all users may review the database information, as well as generating their own data and adding it to the database.

(B) Users also have the option of registering as a paying user (hereafter "paying user"). Paying users have access to additional advanced search features, such as full access to the database, including application information added by other users.

(C) Before accessing fee-based areas, users will be informed about the fees required, the scope of services, and payment conditions, and upon payment may access these areas. A price list is also available in §5 of these Terms and Conditions.

(D) The database portal is offered exclusively for commercial purposes. No type of private use whatsoever is permitted, neither under free use (see §2 Par. A of these Terms), nor under paid use (see §2 Par. B of these Terms).

(E) The provider is entitled to assign third party service providers and fulfillment agents to fulfill portions or the entire scope of services, so long as no disadvantages are incurred by the user.

(F) The provider cannot guarantee the existence of any particular data record, and therefore cannot be held liable if the requested record does not exist or is incomplete.

3. Contract agreement and start

(A) The user has the option to save or print these Terms before agreeing to this contract. The contract between the provider and the user governing use of the database is enacted by the user's registration.

(B) The contract between the provider and the user governing use of the database is enacted by the user's order. The provider shall permit full access only after payment has been received.

(C) The contract period for paying users begins upon activation by the provider.

(D) A contract under Paragraphs A and B is valid only once the user has been accepted as such. The provider is entitled to verify the user's identity against appropriate official documentation. The user therefore agrees to transmit copies of official documentation to the provider upon request, in particular regarding corporate registration.

4. Right to cancellation

(A) The user may cancel the contract declaration within a period of two weeks, without providing a reason, by sending written notice by letter or fax to folienpreise.de at the address specified in Section 8. This cancellation notice will be retransmitted to you separately in text form. The period begins on the day you receive the cancellation instructions in text form. To comply with the cancellation period, it is sufficient to send the cancellation in a timely manner.

(B) In the event of a valid cancellation, any benefits received by either party shall be returned, as well as any services used. If the benefits received from the provider cannot be returned in whole or in part, then the user shall provide indemnification of equivalent value.

(C) The right to cancel expires prematurely if the provider has performed services with the user's express approval before the cancellation deadline, or when the user has initiated such services on his or her own (by activating the profile, or use of the service).

5. Amounts supplied

Our merchandise is intended only for end users and is not for resale. We therefore reserve the right to ship materials only in normal household amounts. If necessary, you may be notified by us via e-mail.

6. Reservation of ownership

Products remain our property until payment has been received in full.

7. Guarantee and Liability

The guarantee period lasts two years once materials have been delivered. Obvious defects are to be reported in writing no later than three days after the materials have been received. In guarantee cases, we are entitled at our discretion either to correct the defect, to replace the shipment, or to refund the purchase price. If the repair or replacement is not effective, you may cancel the contract or demand a reduction of the purchase price. Additional claims from the customer (in particular damage compensation claims) are prohibited, unless the damage was caused intentionally or is due to gross negligence by us or our fulfillment agents.

8. Data security

The personal data required to conduct the contractual agreement are to be made available by the customer. The personal data required for business transactions will be saved and may be forwarded to third parties within the scope of proper completion of the ordering process. The data shall be handled in accordance with the provisions of the German Data Protection and Telecommunications regulations. All personal data will be treated strictly confidentially. We guarantee you the highest security standards. We are committed to protecting your data against any unauthorized access. For purposes of credit assessment and monitoring, we conduct data exchanges; your protected interests shall be respected in this regard. Please note: In accordance with §28 Par. 4 of the German Federal Data Security Law and §4 Par. 3 of the German Telecommunications Data Security Law, you may object or withdraw your consent to the usage and/or processing of your data described above at any time, by giving notice to info@folienpreise.de. Upon receipt of your objection or withdrawal, we will no longer use the affected data.

9. Legal Jurisdiction

For commercial transactions with business persons (German: "Kaufleute") and legal entities under public laws, the city of Bergen/Ruegen is hereby agreed as jurisdiction for all legal disputes. In transactions with end users, the customer's right to the residence of the end-user is also applicable, in as much as it absolutely deals with legal provisions relating to rights of the consumer.

10. Final Provisions

If one or more provisions of these terms be invalid, the validity of the remaining provisions shall not be affected. The ineffective regulation shall be replaced by the relevant legal provision. This contract governed exclusively by German law and excluding the UN Sales Convention.
